Plaintiff Water Quality Insurance Syndicate (“WQIS”) seeks judicial review under the Administrative Procedures Act, 5 U.S.C. § 551 et seq. (“APA”), of the final agency action by the United States Coast Guard National Pollution Funds Center (“NPFC”). The NPFC denied plaintiffs claim under the Oil Pollution Act of 1990, 33 U.S.C. § 2701, et seq.
