In an action, inter alia, to recover damages for personal injuries, the defendant J.E Phillips, Inc., appeals, as limited by its brief, from so much of an order of the Supreme Court, Kings County (F. Rivera, J.), dated December 3, 2004, as denied its motion for summary judgment dismissing the complaint insofar as asserted against it.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the motion is granted, the complaint is dismissed insofar as asserted against the defendant J.E Phillips, Inc., and the action against the remaining defendant is severed.
