*894In an action to recover damages for personal injuries, the defendant Home Depot U.S.A., Inc., appeals, as limited by its brief, from so much of an order of the Supreme Court, Richmond County (Maltese, J.), dated April 10, 2008, as denied those branches of its motion which were for summary judgment dismissing the complaint insofar as asserted against it to the extent that its seeks recovery on a theory of respondeat superior, and dismissing all cross claims insofar as asserted against it.
