OPINION AND ORDER

Plaintiff Dennis Joslin appeals from a judgment of the United States Bankruptcy Court for the Southern District of New York, John J. Connelly, Judge, denying plaintiffs motion for an extension of time in which to file a notice of appeal. Plaintiff contends that his late filing was justified by “excusable neglect.” On appeal, plaintiff claims the Bankruptcy Court erred by failing to apply the Pioneer guidelines for determining what forms of neglect may be considered excusable.
