In the adversary proceeding below, Irving H. Picard (the “Trustee”), as Trustee for the substantively consolidated Securities Investor Protection Act (“SIPA”)1 liquidation of Bernard L. Madoff Investment Securities LLC (“BLMIS”) and Bernard L. Madoff, brought an application seeking injunctive relief against MAXAM Absolute Return Fund Ltd. (“Maxam Limited” or “Appellant”).
