KING, Circuit Judge:

A Texas state court convicted the Petitioner-Appellant Kenneth Story (Story) in 1985 of aggravated sexual assault. After exhausting his state court remedies, Story brought this habeas corpus petition in federal district court, alleging that the Texas Department of Corrections (TDC) refused to consider him for administrative good conduct time in violation of the ex post facto clause of the United States Constitution.
