The only question presented on this appeal is whether the court ruled correctly in ordering a new trial of the case upon its own motion. The power of the court to grant a new trial is unquestioned. The only question for consideration is, Did the court act properly in ordering the new trial? Such action by the court is clearly within' the field of discretion, and is not to be reviewed on appeal unless it appears that there was an abuse of this discretion.
