MEMORANDUM

Plaintiff James P. Benvenuti brings this action for monetary, declaratory, and in junctive relief against the United States Department of Defense and Department of the Army, and against seven officers of the Army and Navy in their individual capacities. 1 Currently before the Court is defendants’ motion to dismiss, or in the alternative, for summary judgment. 2
