Mrs. Elizabeth Jones was driving when her car collided with a truck. Her husband, Calvin Jones, who was a passenger in the car, died of the injuries he received in the accident. Linda Jones, Calvin’s daughter and administratrix of his estate, brought a wrongful death action against her stepmother Elizabeth and the trucking company. Elizabeth filed a motion for summary judgment asserting that the doctrine of interspousal immunity barred the suit against her.
