HAWLEY, District Judge.

This is an action to recover damages for injuries received by the defendant in error (hereinafter designated as “plaintiff”) from the falling of a smokestack through the carelessness and negligence of the plaintiff in error (hereinafter designated as “defendant”) in erecting the same.
