BENDER, J.:

¶ 1 This is an appeal from a judgment entered in favor of Appellees in an action for personal injury resulting from an automobile accident. Appellant raises three issues for our consideration: whether the trial court erred in excluding from the jury videotape surveillance evidence of Appel-lee, Ireneusz “Eric” Mietelski, due to unfair surprise and prejudice caused by late production of the tape; whether the court erred in failing to charge the jury that it had to consider whether Appellant’s negligence was a substantial factor in producing Eric Mietelski’s injuries; and…
