The' defendant was convicted at a court of Oyer and Terminer, held in and for the city and county of Hew York, of the crime of murder in the first degree, for the killing of Madeline Goelz. From the sentence of death pronounced upon him he has appealed to this court, alleging various grounds in support of his appeal. The indictment was drawn in common-law form, and in one count charged "the killing to have been done willfully, feloniously, and with malice aforethought. The defendant objected that such an indictment was not sufficient to sustain the conviction of the defendant for the offense…
