The defendant was indicted and convicted in the Court of General Sessions of Mew York of the crime of murder in the first degree, for having killed one Peter Keenan on the night of November 3, 1883, by means of a pistol. The killing was not denied, but it was urged in defense that there was an absence of that deliberation and premeditation essential to the commission of the crime charged, and that the defendant was insane at the time of its perpetration.
