Memorandum

LEIGHTON, District Judge.

This is an action brought pursuant to Section 301 of the Labor Management Relations Act, 29 U.S.C. § 185 (LMRA), for unlawful discharge and breach of the duty of fair representation. On September 9, 1981, after 20 years on the job, plaintiff John H. Weller was discharged from his employment as a dockworker with the defendant Glendenning Motorways, Inc. (GMW) for excessive absenteeism. He filed a grievance; on September 28, 1981, pursuant to the collective bargaining agreement, a grievance hearing was held.
