Tommy Lee Dunlap appeals the trial court’s denial of his motion to vacate void sentence. On March 27, 1992, Dunlap pled guilty to theft by taking and was sentenced to ten years imprisonment which was suspended upon the payment of a fine and the condition of banishment from Emanuel County. On April 3, 1992, after a hearing, the trial court ordered that Dunlap be confined for ten years after he violated the banishment condition by being present in Emanuel County.
