McMURRAY, Presiding Judge.

This is a discretionary appeal from a revocation of probation. Defendant Bryson entered a plea of guilty to aggravated assault and was sentenced to ten years confinement, one to serve and the remaining nine years to be served on probation. The sentence was filed on September 29, 1995, while a petition for revocation of probation was filed on October 9, 1996.
