The complaint alleges that the plaintiff is a Pennsylvania corporation; that prior to the bringing of this action one Charles H. Welles, Jr., “ was appointed permanent receiver in equity for the plaintiff by the United States District Court for the Middle District of Pennsylvania, but that no receiver or ancillary receiver of the plaintiff has been appointed in the State of New York * * *. That this action is brought with the knowledge, consent and approval of said receiver, and is intended by the plaintiff to be in aid of said receivership.”
