The plaintiff in error, hereinafter called defendant, was convicted in the district court of Canadian county of the crime of assault with intent to commit rape, and was sentenced to serve a term of one year in the state penitentiary.
The defendant was charged with assault with intent to commit rape upon one Opal Harding. Upon the trial of the case the state called Opal Harding, then the wife of defendant, and offered her as a witness against the defendant.
