The defendant, Dewey Hilyard, was charged by information filed in the district court of Mus kogee county with the crime of grand larceny, was tried before a jury, convicted, and his punishment fixed at imprisonment in the State Penitentiary for a term of five years. Appeal has been perfected to this court.
