OPINION

TIPTON, Judge.

The defendant, Donald Wayne Burlison, was convicted by a jury in the Hickman County Circuit Court of first degree murder and aggravated assault. He was sentenced to concurrent terms of life and three years in prison. In this appeal as of right, he contends the following:(1) The evidence was insufficient to prove the element of premeditation, which is necessary to convict for first degree murder, beyond a reasonable doubt.(2) The trial court erred in refusing to grant a new trial as the thirteenth juror under Tenn.R.Crim.P. 33(f).(3) The convictions for both murder and…
