MEMORANDUM OPINION

HENRY L. HESS, Jr., Bankruptcy Judge.

On September 22, 1980 the debtor filed herein his petition for an order for relief under chapter 7 of 11 U.S.C. On October 1, 1980 an order was entered appointing an interim trustee. The § 341(a) meeting of creditors was held on November 3, 1980. On November 9, 1980 the debtor filed a motion to convert his case to a case under chapter 13 and at that time also filed a chapter 13 statement and a chapter 13 plan.
