LUCERO, Circuit Judge.

This case is on appeal from the Tenth Circuit Bankruptcy Appellate Panel (“BAP”). We consider first whether the BAP erred in determining that a conversion from Chapter 7 to Chapter 13 — before a Chapter 13 plan was approved — was a final, immediately appealable order such that an appeal subsequent to approval of the Chapter 13 plan is untimely. Determining that the appeal is timely, we inquire into whether the bankruptcy court erred as a matter of law in allowing a conversion to Chapter 13 after discharge was obtained under Chapter 7, and whether the bankruptcy court…
