Appeal from a judgment of the County Court of Albany County (Ceresia, J.), rendered February 1, 2013, convicting defendant upon his plea of guilty of the crime of strangulation in the second degree.

In satisfaction of two pending indictments charging him with assault in the third degree, attempted rape in the first degree, strangulation in the second degree, unlawful imprisonment in the first degree and criminal sale of a controlled substance in the third degree, defendant pleaded guilty to one count of strangulation in the second degree and waived his right to appeal.
