SUTTON, Justice.
This appeal is from the 41st District Court of El Paso County, in a death action.
Mary Elizabeth Burt, a feme sole, and vthe surviving wife of Richard Burt, de*916ceased, sued Jesse H. Lochausen, Jr., and The Life Insurance Company of Virginia, a corporation, to recover damages for the death of the deceased husband resulting from an automobile accident just west of the city limits on U. S. Highway 80-A in El Paso County March 6, 1950.
