Plaintiff brought suit as administratrix of the estate of her brother, Charles Henry Going, deceased, to recover damages on account of his death on February 24, 1919, which occurred as the result of deceased being struck by an interurban car of the defendant, on Michigan avenue, near Dearborn, Michigan. Defendant’s motion to direct a verdict in its favor, made at the close of the plaintiff’s case, and renewed at the close of the testimony, was reserved under the Empson act.
