OPINION

MARGOLIS, Senior Judge.

This takings action is before the Court on defendant’s motion to dismiss or, alternatively, for summary judgment, and on plaintiffs’ cross-motion for partial summary judgment *572on the issue of liability. After carefully considering the parties’ motions and after a hearing in court, defendant’s motion for summary judgment is granted as to all Counts. Plaintiffs’ cross-motion for partial summary judgment is denied.
