The plaintiff in error was convicted and his punishment fixed at two years in the penitentiary, upon an information charging him with assault with intent to kill one Jim Carter, by shooting at him with a pistol. From the judgment entered in pursuance of the verdict, he appealed by filing in this court on March 6, 1914, a petition in error with case-made.

The evidence shows that in the afternoon of the day alleged, Jim Carter and his father, Duval Carter, rode down the main street of Tahlequah, and when about opposite the Red-burn Hotel they stopped to talk with some person, and the defendant,…
