MANTON, Circuit Judge.

On June 8, 1928, the barge Reno was under a demise charter, made by the appellee Taylor acting as agent for the appellee Bames-Ames Company, Ine. Below it is held that the charter was by Taylor who later *967subchartered the boat to Bames-Ames Company, Inc. It was loaded with grain by tho Bames-Ames Company, Inc., in Brooklyn, on June 9, 1928 (Saturday), and towed that afternoon to Hoboken and moored on the south side of Pier 1.
