National Distributing Company, Inc. (hereinafter “National”) filed a petition in superior court seeking a declaratory judgment and injunctive relief against Premium Distributing Company, Inc. (hereinafter “Premium”) and the Georgia Commissioner of Revenue (hereinafter “Commissioner”). The petition sought to have Premium barred from pursuing and the Commissioner barred from asserting jurisdiction over an administrative proceeding brought by Premium.
