I. INTRODUCTION
The plaintiff, Stephen P. Troy, Jr. (“Troy”), brings this action pursuant to 35 U.S.C. section 146 (“Section 146”), seeking judicial review of a final decision and order (the “Decision”) of the Board of Patent Appeals and Interferences (the “Board”) of the United States Patent and Trademark Office (the “PTO”) in Patent Interference No. 105,698.
