ORDER
DOTY, District Judge.
This matter is before the court on plaintiff’s motion for injunctive relief and defendants’ motion to dismiss or in the alternative for summary judgment. Based on a review of the file, record and proceedings herein, and for the reasons stated below the court denies plaintiffs motion for injunctive relief and grants defendants’ motion to dismiss. 1
