Two of Minnesota’s taconite mining and processing companies challenge the constitutionality of portions of the Minnesota Iron Range Resources and Rehabilitation Board’s (“the IRRRB”) 1 enabling statute. The companies contend the fund disbursement method set forth in Minn.Stat. § 298.227 impermissibly interferes with the collective bargaining process. As a result, the companies claim the statute is preempted by federal labor law.
