Baker, receiver of the International <& Great Northern Railway Company, and the Galveston, Houston & Henderson Railway Company. From a judgment for plaintiff against defendant receiver, the latter appeals.

This was a suit by the appellee, Martin B. Grace, against appellant, James A. Baker, in his capacity as receiver of the International & Great Northern Railway Company, and also against the Galveston, Houston & Henderson Railway Company, by which appellee sought to recover damages for personal injuries alleged to have been sustained by him in consequence of certain negligence on the part of said defendants. Afterwards, and before trial, ap-pellee dismissed his suit as against the Galveston, Houston & Henderson Railway Company, and the case proceeded to trial against appellant as the sole…
