The original opinion in this case as written by my .esteemed associate, Mr. Justice BARCUS, reversed the judgment and remanded the cause to the trial court on several grounds. While I concurred in that opinion at the time it was handed down, I had some misgivings with reference .to that part of the same which based our reversal in part on the declaration that the evidence was insufficient to support the judgment with reference to the issue of whether the fire which caused the damage sued for originated on the right of way of appellant, and whether it was caused…
