This is an appeal on questions of law from an order of the Court of Common Pleas of Defiance county, overruling a motion of defendant to dismiss a motion of the plaintiff to vacate an order of the Court of Common Pleas made on April 6, 1943, and allowing a motion of .the plaintiff to vacate the former order of the Court of Common Pleas of April 6, 1943; and from the judgment of the Court of Common Pleas vacating the order of April 6, 1943, which awarded the custody of the minor child of the parties who were divorced.
