In August 1974 Franklin Valvo commenced, in superior court, a proceeding in mandate against the University of Southern California and its board of trustees. In his second amended petition for writ of mandate, petitioner alleged that in March 1967, when he was a chird-year student in the university’s school of medicine, respondents summarily dismissed him from the school. Petitioner sought to compel respondents to reinstate him as a third-year medical student in good standing.
