Pro se petitioner Frank Carbone, a/k/a Steve Ascanio, filed this motion pursuant to Federal Rule of Civil Procedure 60(b)(4) seeking reconsideration of this Court’s pri- or judgment dismissing his petition for writ of habeas corpus filed pursuant to 28 U.S.C. § 2254. For the reasons explained below, the petitioner’s motion is denied.
