This is an appeal from the Circuit Court for Charles County by Joseph Saldiveri (the defendant) from a conviction for an unnatural and perverted sexual practice upon an eight-year old girl.

The girl, a hospital patient, was confined to her bed with a fractured leg. On Sunday afternoon, June 23, 1957, she was visited by her mother. At about five-thirty the mother went to a restaurant for supper.
