MEMORANDUM OPINION ON CROSS MOTIONS FOR SUMMARY JUDGMENT ON COMPLAINT TO AVOID ALLEGED PREFERENTIAL TRANSFERS

Andrew J. Maxwell (“Trustee” or “Plaintiff” ) seeks to avoid and recover two alleged prepetition transfers as preferences, pursuant to 11 U.S.C. § 547(b). He has moved for Summary Judgment. Paceset ter Steel Service', Inc. (“Pacesetter”) cross motioned for Summary Judgment.
