MEMORANDUM OPINION
RONALD S. BARLIANT, Bankruptcy Judge.
The Debtor has moved to dismiss Count I of Chicago City Bank & Trust Company’s first amended complaint to determine the dischargeability of a debt and objecting to the discharge of the Debtor. Count I alleges that the Debtor is not entitled to a discharge of the debt due the Bank because that debt is for embezzlement or larceny of funds in which the Bank had an interest or, alternatively, for the willful and malicious injury to such property interest of the Bank.
