This action was brought to set aside a will signed by John W. Kitchell, by which he gave all of his property to Samuel N. Bridgeman. Its validity was challenged by the plaintiffs, who were his brothers and sisters, or the heirs of those who stood in that relation to him. The will was assailed on several grounds, only one of which was sustained by the court. That ground was that the will was not attested and subscribed in the presence of the testator by the witnesses.
