DOOLING, J. pro tem.

Plaintiff sued to recover sales taxes and use taxes paid under protest. The court gave judgment ' for plaintiff for the use tax and for defendant on the sales tax, and an appeal is here presented by each party as to the portion of the judgment unfavorable to that party. The two appeals present distinct questions and will be separately-dealt with.
