HEANEY, Circuit Judge.
Edison Brothers Stores Pension Plan and the individual members of the Plan’s Retirement Committee appeal from a decision of the District Court denying their motion for summary judgment and granting the motion for summary judgment of *309Henry Winer and the Secretary of Labor.1 The appellants argue that the District Court erred in determining that Winer and Joseph M. Fingerhut were entitled to receive pension benefits notwithstanding the Committee’s finding that they had violated the Plan’s “bad boy” clause. We affirm.
