Plaintiff was formerly employed as a sales associate in the *206computer department of defendant Sears’ store on Fordham Road in the Bronx. On September 18, 1996, plaintiff entered a transaction into a cash register for the sale of an Apple computer, charging it to the account number of a Sears credit card holder named Gwendolyn Taylor. Plaintiff’s employee number appears on Sears’ computer detail display of the receipt and he readily admits that he is the person who conducted the sale.
