James, J.), entered August 5, 2004, which denied the motion of defendants Fleisher and Assist Sports Management to dismiss the complaint pursuant to CPLR 3211, unanimously reversed, on the law, with costs, and the motion granted. The Clerk is directed to enter judgment in favor of said defendants dismissing the complaint as against them.
