The plaintiff in error brought an action to recover from defendants in error the sum of $822.62, with interest from the 1st of November, 1913, being the amount of one-half the profits *200which the plaintiff claimed resulted to the defendants upon the purchase and sale of 1,000 barrels of sugar.
In his petition the plaintiff claimed that he entered into a contract with the defendants, whereby he sold, to them 1,000 barrels of sugar from the Warner Sugar Refining Company at the then market price of $4.20 a hundred pounds, New York basis, the delivery of the sugar to be held off as long as possible,…
