Michael and Carol Duersten appeal from a circuit court order denying their motion to vacate judgments entered against them. We reverse the trial court’s order.
Judgments were entered against the Duerstens in an action brought by Robert Howard, et al., hereinafter called the Howards, against Crestway Homes, Inc. and its officers and directors, Michael and Carol Duersten. The complaint, filed August 12, 1974, alleged that the Duerstens had fraudulently depleted assets of Crestway Homes, Inc. and that as a result the Howards were not able to satisfy judgments previously rendered in their favor…
