The petitioner (the respondent herein), for the purpose of acquiring the right, privilege, and easement of erecting and operating a public grain elevator for the public, for hire, upon a site on the right of way of the appellant railway company, presented to *516it an application therefor on June 7, 1894. The application was denied, and thereupon the petitioner, on June 29, 1894, presented to the district court his petition for condemnation of such right and easement, under the provisions of Laws 1898, c. 64 (G-.
