Appeal from a judgment of the Supreme Court (Dier, J.), entered December 10, 1993 in Warren County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of respondent that a prior nonconforming use would be permitted to resume operation in a residential zone.

Petitioner is a property owner in the Town of Hague, Warren County, and owns and resides on property directly across from the former Open Hearth Restaurant (hereinafter Open Hearth). In 1977 the Town of Hague adopted its first zoning ordinance which zoned this area as a…
