MEMORANDUM OPINION AND ORDER

Before the Court are the Plaintiffs’ Motion for a Preliminary Injunction [Docket Entry # 13] and Defendant’s Motion to Dismiss [Docket Entry # 21]. For the reasons stated below, both Motions are DENIED.

I. BACKGROUND
